By accessing or using CageList ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. CageList reserves the right to modify these Terms at any time. Continued use of the Platform after any modification constitutes acceptance of the updated Terms.
CageList, LLC, a Florida limited liability company, operates an online marketplace that (a) connects batting cage owners ("Hosts") with individuals seeking to rent batting cage time ("Players"), and (b) may connect homeowners seeking batting cage construction or installation ("Homeowners") with independent batting cage builders ("Builders") through CageList's Builder Network directory and lead-matching tools. CageList facilitates the discovery, booking, and payment of batting cage rental sessions and may facilitate introductions between Homeowners and Builders, but is not itself a provider of batting cage rental services, construction services, or contracting services.
You must create an account to use certain features of the Platform. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information, including your date of birth when requested for age verification. You must be at least 18 years old to create an account, book a cage, list a cage, or otherwise transact through the Platform. Minors may participate in batting cage sessions only under the supervision of a parent or legal guardian who creates the account, accepts these Terms, signs any required waiver, and remains responsible for the minor's conduct and safety.
All bookings are subject to Host availability and acceptance. Payments are processed through Stripe. For Instant Book reservations, payment is processed when the booking is submitted. For Request to Book reservations, CageList may authorize the Player's payment method when the request is submitted and capture payment only if the Host approves the request. Prices displayed include applicable fees ("all-in pricing"). CageList charges a Guest Service Fee to Players (10% of booking total unless otherwise displayed at checkout) and a commission to Hosts (10% of booking total unless otherwise displayed at checkout). Hosts may offer optional paid add-ons (such as equipment), priced either flat or per hour, with an optional minimum charge; any add-ons a Player selects form part of the booking total and are subject to the Host commission. The Guest Service Fee applies to cage time and is not charged on add-ons. Refunds are subject to the Host's cancellation policy as displayed on their listing.

View Privacy PolicyStandard cancellation policy allows free cancellation up to 6 hours before the scheduled session. Late cancellations (less than 6 hours) may be subject to a cancellation fee as specified by the Host. No-shows forfeit the full booking amount. Hosts who cancel confirmed bookings may be subject to penalties and/or account restrictions.
Hosts are responsible for: maintaining accurate and up-to-date listing information; ensuring their facilities are safe, clean, and as described; complying with all applicable local laws, regulations, zoning requirements, and third-party property obligations; maintaining appropriate insurance coverage; responding to booking requests in a timely manner; honoring confirmed bookings; collecting and remitting any applicable taxes; and completing any required Stripe Connect onboarding before receiving payouts. Hosts are independent third parties and are not employees, agents, partners, or representatives of CageList.
CageList may review, edit, reorder, or remove listing content you submit—including titles, descriptions, photos (including display order and captions), and pricing-related display text—to improve accuracy, search visibility, safety, compliance with these Terms, or overall marketplace quality. You retain ownership of content you submit, subject to the license granted in Section 12. Hosts remain responsible for ensuring that their facilities and services are accurately represented on the Platform, regardless of any edits CageList makes.
Players are responsible for: using cages safely and in accordance with Host rules; treating Host property with care and respect; signing required liability waivers before each session; arriving on time for booked sessions; reporting any damages or safety concerns immediately; and using appropriate safety equipment.
Players must sign a digital liability waiver before participating in any batting cage session booked through the Platform. By signing the waiver, you acknowledge the inherent risks associated with batting cage activities and release CageList and the Host from certain liabilities as outlined in the waiver.
CageList is not an insurance provider and does not offer liability insurance, property damage coverage, or any insurance product. Every booking includes secure Stripe payments, a signed digital waiver, and access to CageList's support team for booking disputes as described in Section 15. Hosts are responsible for maintaining their own appropriate insurance coverage.
If you apply for or participate in CageList's Builder Network — whether as a Builder or as a Homeowner seeking builder quotes — you agree to the following. Independent relationship. Builders are independent businesses or contractors. They are not CageList employees, agents, partners, or representatives. CageList does not perform construction work, supervise job sites, set pricing for build projects, or act as a general contractor, escrow agent, or insurer. Any contract for construction or installation is solely between the Homeowner and the Builder. Profile review. CageList may review builder applications and approve profiles for inclusion in the public builder directory. Approval or the use of terms such as "reviewed" or "vetted" on the Platform means that CageList has performed a limited profile review — it does not constitute verification of licensing, bonding, insurance coverage, background checks, workmanship, or legal compliance. You are responsible for evaluating any Builder before hiring them. Builder applications. If you apply to join the Builder Network, you agree to provide accurate business information, service area, portfolio materials, and contact details. CageList may display approved profile information publicly in the builder directory. Lead matching. Homeowners may separately opt in to share project details (such as location, budget range, timeline, and contact information) with up to three Builders selected by CageList. Before contact details are disclosed, Builders may receive an anonymized project summary and a time-limited opportunity to claim the lead. If a Builder claims a lead, the Homeowner's name, email, and phone number may be shared with that Builder so they can follow up directly. CageList does not guarantee that any Homeowner will be matched, that any Builder will receive leads, or that any project will proceed. Direct quote requests. Homeowners may also submit quote requests directly from an individual Builder's public profile. In that case, the contact information and message you submit may be sent directly to that Builder. Builder obligations. Builders must use Homeowner contact information only to respond to the relevant project inquiry; comply with applicable telemarketing, privacy, and consumer-protection laws; maintain their own licenses, permits, insurance, estimates, contracts, workmanship standards, and tax obligations; and contract directly with Homeowners. No guarantees. CageList does not guarantee lead volume, project conversion, revenue, response times, project quality, timelines, or any particular outcome. Any fees displayed for lead claims (including promotional or free offers) do not guarantee that a lead will convert into a signed contract or completed project, and lead fees are generally non-refundable unless otherwise stated at checkout. CageList rights. CageList may approve, reject, pause, or remove a builder profile or lead access at any time to protect users, quality, or marketplace trust.
CageList may offer referral credits, promotional credits, promo codes, or similar incentives, subject to these Terms and to any additional rules displayed in the applicable program materials (including on the Referrals page and at checkout). How credits are earned: Referral rewards are earned only when the referred user completes a qualifying transaction — not upon sign-up. For player referrals, both the referring user and the referred user earn credit when the referred user completes their first paid booking. For cage (host) referrals, the referring user earns credit when a cage they referred is published and approved by CageList, and the newly referred Host earns credit upon their first paid booking as a Host. A single referral link may result in either type of reward depending on how the referred user participates. Reward amounts are those displayed in the applicable program materials at the time the reward is earned. How credits are used: Credits have no cash value, may be used only on the Platform, and may not be transferred, sold, or redeemed for cash. Credits are applied automatically at checkout and may be redeemed only against qualifying bookings that meet the minimum booking amount displayed in the applicable program materials (currently $50). Credit redemption may be limited to Instant Book bookings and to the portion of a booking retained by CageList as its fee, so that redeeming credit does not reduce amounts owed to a Host. Any unused balance carries forward to future qualifying bookings until it expires. Expiration: Unless otherwise stated in the applicable program materials, referral and promotional credits expire 180 days after they are earned; expired credits are removed from your balance and cannot be reinstated. Limits and integrity: CageList may limit the number of rewards an account can earn within a given period, and may cap, decline, delay, withhold, revoke, or claw back credits — including after they have been applied — in cases of actual or suspected fraud, self-referral, duplicate or fake accounts, purchased or incentivized sign-ups, chargebacks, refunds, cancelled or reversed bookings, or any violation of these Terms. If a booking against which credit was redeemed is later cancelled, refunded, or reversed, CageList may reverse the corresponding credit. Changes: CageList may modify, suspend, or discontinue any referral or promotional program, or change reward amounts, minimums, expiration periods, or eligibility rules, at any time and without notice; the terms in effect at the time a reward is earned govern that reward.
Users may not: use the Platform for any unlawful purpose; provide false or misleading information; interfere with the operation of the Platform; circumvent CageList's payment system; harass, threaten, or discriminate against other users; misuse or damage Host property; attempt to book sessions outside the Platform to avoid fees; misuse Homeowner contact information received through the Builder Network; solicit or use lead information for unrelated marketing; or misrepresent licensing, insurance, qualifications, or affiliation with CageList.
All content, trademarks, logos, and intellectual property on the Platform are owned by CageList or its licensors. Users retain ownership of content they submit (photos, reviews, listings, messages, and other materials) but grant CageList a non-exclusive, worldwide, royalty-free license to host, use, reproduce, display, distribute, modify, and promote such content in connection with operating, improving, marketing, and protecting the Platform. You represent that you have the rights needed to submit your content and that it does not violate law or third-party rights.
CageList provides a dispute resolution process for issues between Hosts and Players arising from bookings on the Platform. Both parties agree to first attempt to resolve those disputes through CageList's mediation process. Disputes between Homeowners and Builders relating to construction quotes, contracts, workmanship, payment, or project outcomes are between those parties; CageList is not a party to any construction agreement and does not mediate builder-project disputes except where we choose to do so in our sole discretion. If mediation fails, disputes covered by this section will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court where permitted. You and CageList each waive the right to participate in a class action, class arbitration, or other representative proceeding. You may opt out of this arbitration and class-action waiver by emailing legal@cagelist.com within 30 days of first accepting these Terms.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless CageList, LLC and its owners, officers, employees, contractors, affiliates, service providers, and agents from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Platform, your content, your listing, your booking, your facility, your guests or invitees, your builder services, your violation of these Terms, your violation of law, or your interaction with another user.
CageList is a marketplace platform and is not liable for: the actions, omissions, or conduct of any Host, Player, Builder, Homeowner, guest, invitee, or third party; the condition, legality, availability, quality, or safety of any listing, facility, equipment, service, or build project; injuries sustained during batting cage sessions or during construction, installation, or repair work performed by a Builder; property damage arising from builder services; or any indirect, incidental, special, punitive, exemplary, or consequential damages. The Platform is provided "as is" without warranties of any kind. To the fullest extent permitted by law, CageList's total liability for any claim relating to the Platform or these Terms will not exceed the greater of (a) the amounts you paid to CageList in the 12 months before the event giving rise to the claim, or (b) $100.
CageList is not responsible for delay or failure to perform caused by events beyond its reasonable control, including natural disasters, severe weather, fire, flood, labor disputes, acts of government, war, terrorism, civil unrest, internet or telecommunications failures, payment processor outages, service-provider failures, utility failures, or other events outside CageList's reasonable control.
CageList may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or other reasons at our sole discretion. Upon termination, all pending bookings may be cancelled, and any remaining balances will be handled in accordance with our refund policies.
If you believe content on the Platform infringes your copyright, send a notice to legal@cagelist.com with: your contact information; a description of the copyrighted work; the specific URL or location of the allegedly infringing material; a statement that you have a good-faith belief the use is not authorized; a statement under penalty of perjury that your notice is accurate and that you are the copyright owner or authorized to act for the owner; and your physical or electronic signature.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Subject to the arbitration provision above, any legal proceedings must be brought in the state or federal courts located in Osceola County, Florida.
If you provide a mobile phone number, CageList may send SMS messages related to account verification and your booking activity, including verification codes, booking confirmations, inquiries, approvals, declines, expiration notices, reminders, and message-received alerts. CageList does not send SMS marketing unless you separately opt in. Message frequency varies based on account and booking activity. Standard message and data rates may apply. Reply STOP to opt out at any time, or HELP for assistance. See Section 6 of our Privacy Policy for full SMS terms, including how we handle your opt-in data.
CageList's Privacy Policy explains how we collect, use, share, and protect personal information. By using the Platform, you also agree to the Privacy Policy, which is incorporated into these Terms by reference.
If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy, Cookie Policy, and any applicable cancellation policy, liability waiver, or program terms incorporated by reference, constitute the entire agreement between you and CageList regarding the Platform and supersede all prior and contemporaneous agreements, understandings, negotiations, and representations, whether oral or written, relating to the subject matter of these Terms.
No failure or delay by CageList in exercising any right, power, or remedy under these Terms will operate as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy will preclude any other or further exercise of that right or any other right, power, or remedy.
You may not assign, transfer, delegate, or sublicense your account, rights, or obligations under these Terms without CageList's prior written consent, and any purported assignment without such consent is void. CageList may assign or transfer its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, and your continued use of the Platform after any such assignment constitutes acceptance.
